These Terms of Service (“Terms”) govern your use of IndiSell Reach (“Reach”, “we”, “us”), a WhatsApp and Instagram marketing and customer-conversation platform operated by Remold Technologies (“Remold”), a partnership firm registered in India (GSTIN 24ABNFR4980N1ZE) and the company behind the IndiSell brand. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you use Reach on behalf of a business, you confirm you are authorised to bind it.
We grant you a non-exclusive, non-transferable right to use Reach for your business while your account is in good standing. You are responsible for your account, your team members’ actions, keeping your login secure, and the accuracy of the information you provide. You must be at least 18 years old.
You must own or be authorised to use the WhatsApp number, Instagram account and store data you connect; message only contacts who have opted in; honour opt-outs promptly; keep the consent and lawful basis for the customers you upload or message; and comply with the Meta WhatsApp Business Policy, Meta’s commerce and messaging policies, telecom/anti-spam rules, and applicable data-protection law (including the DPDP Act, 2023). You are the controller of your customers’ data; we process it on your behalf as described in the Privacy Policy.
No spam, unlawful, misleading, infringing, or abusive messaging; no sending to people who have not opted in; no attempts to disrupt, reverse-engineer or gain unauthorised access to the service. We may suspend or terminate accounts that violate Meta’s policies, these Terms, or applicable law, and may remove content or restrict features to protect the platform and its users.
Paid plans and add-ons are billed in advance for the period you choose; prices are shown on your plan and are inclusive of applicable GST unless stated otherwise. Plan fees are generally non-refundable except where required by law or our published refund policy. WhatsApp conversation charges are billed directly by Meta at Meta’s rates — Reach adds no per-message markup, and you are responsible for those charges. Payments you collect from your own customers are processed by your chosen payment gateway and settle directly to you; Reach is not a payment aggregator and does not hold your funds. We may change fees on reasonable prior notice, effective from your next renewal.
Reach depends on third parties — Meta (WhatsApp Cloud API, Instagram), payment gateways (such as Easebuzz and Razorpay), AI providers, hosting and messaging providers. Their availability, policies and pricing are outside our control, and your use of connected services is also subject to their terms. We are not liable for third-party outages, changes or decisions (for example a Meta template rejection, an account restriction, or a green-tick decision, all of which Meta alone controls).
Reach, its software, and its brand are owned by Remold and its licensors. You retain ownership of your content and your customers’ data. You grant us the limited rights needed to host and process that content to provide the service.
The service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Message delivery depends on Meta and the carriers, and we do not guarantee delivery, uptime, or specific results. To the maximum extent permitted by law, Remold’s total liability for any claim relating to the service is limited to the fees you paid us for the service in the three months before the claim, and we are not liable for indirect, incidental or consequential losses. You agree to indemnify us against claims arising from your misuse of the service or breach of these Terms.
You may stop using Reach and close your account at any time. We may suspend or terminate access for violation of these Terms or the law, non-payment, or risk to the platform. On termination you can export or request deletion of your data as described in our Data Deletion page, subject to records we must keep by law.
We may update these Terms as the service and the law evolve. We will change the “last updated” date above and, for material changes, give reasonable notice in-app or by email. Continued use after an update means you accept the revised Terms.
These Terms are governed by the laws of India. Subject to any right you have under consumer law, the courts at Surat, Gujarat have exclusive jurisdiction over disputes relating to the service.
